I even said just send me another Touch Pro.
She was keying it in and then said "Oh, apparently we can't send you another one because it doesn't show any of these issues as being a known problem, so you'll need to bring it to a repair center".
That is clearly just a cover.
It is likely there is something in the notes or something in the system that essentially blocks any swaps when some criteria is met. Perhaps because I'm listed as getting the Sprint Employee discount (never actually been an employee with them) or perhaps it's just because they gave me a huge discount when I got the Touch Pro. I don't know. This may be a HUGE YMMV. The notes on my account may be tainted by an angry store rep after I corrected him on 3 lies he told in front of customers right before he was forced to give me a deal which he swore he couldn't do.
Or perhaps the system is based on how much money they've made off your account.
If it's none of the above then I must say that the rep I spoke with must surely have been boldly lieing when saying it was the "system" that wouldn't allow me the swap.

hmmmm, ethics... gotta love an ethics convo on a tech website.. feel free to judge my ethics all you want, i hardly care about what im doing obviously... but if everyone was so "ethical" here, none of you would actually be here... no matter what were doing, whether a simple tweak,hack,mod, free tethering, or scammin a new device, its all bad and frowned upon by our carriers..

as far as im concerned, everyone here scams.... your all being "unethical" and misleading to your carriers as well... everytime you flash a rom.. then relock, flash to stock and goto the stores like your NOT screwing with your device... you guys are just deciding whats ethical and whats unethical to suit your own arguments or needs, thats all..

do you tether? do you pay for it?
have a SERO plan you shouldnt technically have?
have a X% corp discount for a company you dont work for anymore or never have in the first palce?
ever mess up your device through flashing and modding, and NOT tell your carrier you were fooling around?
all things that would question your "ethics" if you did/do them.. all misleading or flat out stealing...

anyone doing any of those things, openly talk about it, and tell others how to achieve or hide the same things.. yet i get chastized.. cool.. ill take the haters on, no prob... everyone feel free to hate on me, those who dont, enjoy your TP2s..

as far as me thinking people shouldnt scam, well that was around labor day was it not? thats trhe release time of the TP2.. that was months ago, am i not entitled to change my opinions or something?? have you seen me bash someone for scamming since then really? i decided that I'M my own best interest, not some corporation who cares less about us..

so heckle all you want, but im making an extra 500 bucks a month minimum off it... depends how often TP2 are actually available...

...HMMMMM, i notice noone has complaints about my sig, which was a stickie at 1 point, on how to steal tethering abilities and hide it from your carrier... must be that everyones "ethics" find that kind of stealing to be OK

This is what I want to know. If SERO customers or customers who stand up to liar CSR's have their accounts flagged and subsequently every time we talk to Sprint CSR's they see that unfavorable stuff on our accounts.

I think this is the case. In my case when I broke my TP1 and went through Asurion , a sprint store employee told me to mention them swapping my TP1 for a TP2 since he saw how many exchanges/repairs I have had on my TP1. I got shot down hard when I said to them a store employee told me to ask about switching to a Tp2. They swore a TreoPro was equivalent LOLOLOLOL

I really believe playing dumb is the key.

How many times did you try to call them?

I would say that when you flashed the HTC-Sprint ROM from HTC's website, the phone basically lags and is having issues. Also state that it overheats.

Maybe? Let me know if that works, other than that, I dont know what else to tell them. I haven't tried it so I can only tell you what I would do in your situation.

Playing dumb, in the sense of not speaking of the TP2, clearly didn't work for me as I was satisfied with getting another TP1. I didn't mention the TP2, but I did say that I would be worried that the next TP1 might have similar problems- at which time she then requested her supervisor about a potential upgrade. He shot it down claiming they couldn't authorize upgrades etc, and then she went to try to ship me a TP1 but that didn't work as I explained.

They log your calls to them, but I don't know the level of details they type into the system nor how much they read from prior calls. It might just vary from call to call.

I only called them once. I guess it just takes guts to keep calling regardless of what the notes say about you. I imagine the results would be the same if you call just once or a dozen times. Perhaps eventually you might get lucky and get someone that can't read well and/or is a pushover.

I mentioned the overheating, the rainbow effect on the lcd, the chrome cracking, the keyboard problems, and the lagging and call drops. None of those, according to her, are in the system as known problems. Actually, she did find a note about chrome cracking and she said it mentioned it's caused by dropping the phone. gee thnx

Trust me, Sprint's reps vary. You will get some that don't know what they are doing and some that do know what they are doing. Some write notes, some don't. I had to call as many as 7 different reps when I was trying to activate a Curve 8530, I noticed that it actually helps out when you call more than one rep because then they know you are having a problem. Just remember to be nice to them. lol

Do you have TEP? I think having that will make it easier as well.

Yes I have TEP. Also, I know there is sometimes a difference on where you are routed if your account is listed as a business account, but I have no idea if that's a factor here. For the record, I'm not registered as a business account.

Other potential factors:
I got the TP1 for $200 off because of problems I had with Mogul.

I have two phones on Sprint with the Everything Data Share Plan with 1500 shared minutes. Total cost per month after tax etc: $120.70
