I did it, my new phone is on the way.

NO TEP and worked fine for me. I own my touch pro since last April. I followed steps OP mentioned, changed ROM, called technician explained problems. He walked me through and reset to factory settings and told me he would call me again to check how it works after reset. He called me on exact time and I explain I still have some issues and offered me replacement. I accepted and he is sending me touch pro. Now I don't know it will be touch pro 2 or old refurbish touch pro 1. My confirmation email says

Replacement Phone Information:
Model Name: UTStarcom Touch Pro

Can anyone received touch pro recently?

I will post back here once I get it tomorrow.

Right - only through the stores now, can you get your TP upgraded to a TP2. Your confirmation supports that you'll be receiving a TP and not a TP2.

If I install new ROM op suggested on my new TP1, Would that mess up my new TP1 again?

One should have absolutely nothing to do with the other. I recently installed this Sprint ROM the OP mentions, and in terms of speed, stability, and battery life, no other custom ROM comes close, and I have run quite a few. While I miss WinMo 6.5.x and Sense UI, nothing beats never have to soft reset, and honestly, lightning quick response time switching between open apps...go figure...

I updated my rom to MR to see what would happen, sure enough it tweaked. I called that number, the guy said he would send me a replacement phone in 3-4 days, and that I should receive an email in 40 minutes and he would call me back to verify. He called me back an hour later and offered me all of the phone instead included a TP2. I said I'll take it then he put me on hold and come back and says "I'm sorry put the last one was just accounted for"

I picked the Palm Pre instead but it's okay because I'm sick of windows mobile, and hopefully the nexus one will come to sprint

WTF!!!!!!!!!!!!!!!!!!
i just got my 2nd refurb touch pro dropped off today and the stupid thing is stuck in landscape mode. no matter what i do it won't come out of it. the keyboard doesn't do jack. so i called in today they transferred me twice and i finally got tech support. they were on the phone with me for about 45 minutes trying to figure out what setting i needed to change. she kept telling me to tilt it this way and that way. i know how to work a tp, i have been using one for over a year now. after she couldn't figure it out she offered me a replacement instead of a refurb but the tp2 was OUT OF STOCK so she would only give me a snap, curve, palm something or palm pre. those phones are crap compared to the tp2. i refused the refurb and the other phone options. should i go to the store that did my first two replacements tomorrow or wait a couple of days and call back in to see if they are back in stock?

I hope you had her notate your account to at least show you got the offer? Afterwards, it would be alot easier, at least over the phone, and maybe in-store too.

she did say she would make a note on the account. i said i would prob take it to a store. she referred me to a store that actually services them. i will be there two hours as busy as that store always is. i don't know if i should just go to the smaller store that ordered the first two refurbs and try to get a tp2 or wait to see if they are back in stock in a couple of days. how long are they usually out of stock on something? and how long do i have to send the phones in through the mail. i still have the one that overheats active because the one today i can't even dial numbers on

you have a legit problem and i feel bad for you. i would take it to the nearest repair center, they will help you.
