For those that do not believe in trying to find a better price... More power to you. Continue to pay the outlandish phone prices that Sprint charges their customers and continue to watch new customers get a bargain.

((Ex: Touch $50 for new customer... $250 for my hubby with a 2 yr contract renewal))

It is your right to not want to buy your phone from anyone other than the phone carrier. However, there is nothing wrong with those that are looking to find a cheaper solutions either. There shouldn't be any scammers at all... but unfortunately there are. Coming into a thread of someone who was scammed and is getting a double whammy from their phone company and acting like poor little sprint needs to be defended is not necessary. Don't agree with what the OP did. Fine. Close the thread. It's not like he did anything illegal.

youre reading what you want to read. no one is saying that you shouldnt try to find a better deal, but anyone whos ever been on the internet should know that ebay isnt perfect and scammers exist. the only way to ensure you dont get scammed is to buy directly from the first party, no matter what youre buying. throw in a third party and there is always a likelihood.

sprint didnt charge him, nor did they ship him the phone. nor did the deal with the ebay scammer. if anything the blame should fall on asurion, and while i agree that they shouldnt be able to charge the account the fact remains that that is the policy and the op got scammed because of it. like you said, even with the $58 he came out way ahead than if he had bought through sprint with no discount. for him to attack sprint for something that they had no involvement shows a lack of maturity and lack of willingness to accept what happens when you go deal hunting. something about cake and eating it comes to mind...

It doesn't even make a grain of sense that Asurian/Sprint would charge a new account, instead of the original...

I dont see how you could blame asurion, the issue is sprint charged him for something that he did not agree to pay. When sprint activated the ESN number did they inform him that their would be a $57 charge to activate it? Did the op have a contract with Asurion to pay the fee? If they did not inform him or have a contract then they have no legal right to charge him. It is not asurion fault that sprint allows them to bill customers that they do not have a contract with. In regards to the statement that this is policy, it would seem that is tough luck for sprint. If their is no contract between the op and asurion than they can not collect. For me personally it is my policy not to pay sprint for my plan, though I have that pesky contract that overides my policy.

Say I bought a Sony tv from ebay and hooked it up to my cable and then a month later my cable company had a charge from State Farm saying it was an insurance replacement and I had to pay a deductable I would blame my cable company not State Farm.

Throwing the idea around of someone BESIDES the person who placed the claim, paying the deductable, is blowing my mind. I don't think that is possible. If it is regular practice for insurance companies, someone needs to read up on the laws. If I didn't have a contract with Asurian, there's no way in hell I would pay that fee.

Actually the account is billed before the replacement phone when you call to make a claim, not when activated. Even if you make a claim on the new online form it will ask for a credit # or charge it to the account. That is why it asks for you # and account PIN. The only way I can think that this happened is if the buyer gave his cell # as a contact number to the seller and the seller either works or knows someone who works for sprint. That person could see if the buyer has insurance and bing bang boom...scam is done. It would be as simple as going online and making a claim.

Sprint did have involvement in this. They charged him the $58.

no i dont. sprint is simply collecting the charge, no initiating it. its just things such as jamster. the charges show on your cell bill, but the money does not go to the carrier.
