The OP shouldn't be charged for the $58 that should have been charged to the person making the claim before the phone shipped.... But even if he eats the $58... He still will spend less than if he went through sprint. ((If he is already a sprint customer))

Save the money where you can.

And like someone else said... there shouldn't be any risk to shopping on ebay.

Sprint knows who they shipped the device to. That person should pay the charges.
