Well, there are actually several reasons to buy a phone off of eBay. We have a 4-line family plan. My teenager goes through phones like she does socks. So we needed one without being eligible for a discount - we went on eBay.
Another time, I saw a phone I wanted to try out. Didn't want to extend our contract for it, ordered it on eBay. It's ALWAYS risky to buy a phone off eBay. What helps is to have a trusted seller, checking feedback, ESN and guarantees. But even that might not have protected the OP from this scam. That's why I ONLY buy phones as a gamble, dirt cheap and keeping any losses at a minimum. So far, that worked out great. Only got one bad phone yet and got my money back for it. Lucky! My GOOD phone (HTC TP) of course, I bought through Sprint, with a proper paper trail and insurance to boot.This was NOT an amount of $ I cared to gamble with and I have 30 days to change my mind - legit. |

If in fact no claim was filed with assurion, then make sure you send a letter to sprint customer service (with delivery receipt) the address is on your bill - disputing the charges. State that the charge is in error and that you have not filed any assurion claim. Let Sprint know you are making a complaint with your state's public utilities commission and the FCC and proceed to do so on the respective web sites. Also file a claim with your state's attorney general's office. Getting at least one other agency involved shows that you have in fact disputed the charges so there is a record of it. Then if sprint insists on billing you and never comes up with any proof - either a hard copy with your signature or a voice recording of you from assurion, then they will be ruled against by either your state's PUCO or the AG etc who will direct them to remove the charges under legal penalty and they almost always comply with a governmental ruling. (And if you did call assurion, they record all calls and can easily pull up the conversation so then you are screwed and could get in trouble for fraud).
Just my 2 cents. Scott addendum: [insert foot in mouth] After reading that it was a scam and indeed a claim was filed with assurion now but not by the OP I see that going against sprint might not be the best way. I would instead file an AG claim against the seller for insurance fraud assuming he can be identified. Also I would dispute the $50 charge from assurion in writing unless they can produce your voice or signature authorizing it. It doesn't matter who bills you for it, they must credit is back when you dispute it. It is then up to assurion to go after the person who made an unauthorized claim. So i would still name sprint as a party in the AG filing because they billed you for the unauthorized charge, albeit they are not responsible for originating the charge. GO JUDY!!! GO GO GO GO JUDY!!! Yeah the OP got duped and I feel for him. I hope it all works out. But I think sprint isn't at fault here, It's the scammers. Get his adress and we'll form a possee and go take $57 worth out on him....+ another $2000 for ticking us OFF!!
