Yep I think he did this with over 20+ Diamonds. There are quiet a few people on su.com that bought from this guy as well and were getting phones from Asurion.

Was the guys name dmilton? I just bought my Sprint Diamond off of ebay and it was shipped directly from Sprint. Although before that I bought a Blackberry on Ebay and activated it with no extra charges. If I get charged I will be filing a claim with Paypal. I havent left the guy feedback yet and think I'll hold off.

I bought mine off Craigs List for $400 and flashed it over to cricket.

The same guy who sold me mine sold another one to a guy who didnt want a contract with Sprint and when he tried to activate it sprint told him it was STOLEN! I think mine might be as well but as long as its activated and working on Cricket I dont care.

Moral of this story is buyer beware. Why would you buy a phone off ebay instead of just buying one from sprint directly. Its not worth the time, effort, or little bit cheaper price when you have the option of getting screwed by the seller.

Well i think that both you and the guy who started the thread are right. Sprint is full of crap for trying to charge him, they know good and well how to contact the insurance place and investigate it. On the other hand, buyer beware! If you buy something... well, you bought it.

HERE IS THE RULING:

Judge Jimmiekain says,
Since the seller knowingly sold a product which was known to not be what was expected and the buyer bought it in good faith. I hereby rule that sprint drop all charges to the buyer and must further investigate the sellers actions. In case shall any person who is a victim of fraud be held liable for any charges fees or commissions. If sprint refuses to drop the charges I would dispute the charge to my credit card company (if i used a credit card or credit card with pay pal or dispute it with my bank)

CASE CLOSED! lol

sprint is simply following policy. why should they eat the charges for a scam, when they had nothing to do with it? furthermore, the charges are not coming from sprint, rather asurion.

my point is that customers, sprint ones especially, are quick to blame everyone but themselves for problems. sprint no doubt creates countless issues of their own, but at the same time are often shat on for no good reason when they wont give a customer something for free, etc.

Get in touch with CS by email, sending them a copy of the ebay listing, pay-pal recipt, and any contact info you have for the seller. File a dispute with ebay AND pay-pal. Then call CS and report the issue to them referencing the email you send to CS. I'm sure Sprint will want to stop this guy since he is technically scamming them as well as you. If you can look at his feedback and get anyone else who got the phone off him to do the same that will only help your case.

its not totally sprints fault at all, i agree with the others on this site. Its the ebay members fault. The phone was obviously part of some scam. Dont you think its weird when someone has like 20 brand new diamonds all new in the box. Sprint is not full of crap, the ebay member is.

I sent the CSR my ebay receipt and they replied by telling me that they were sending my case to another "department". Ehh hopefully the CSR was talking about Asurion to find any call logs or emails exchanged between me and Asurion. I have made no contact with Asurion at all during my time with Sprint so hopefully this will clear things up
