I dont see how you could blame asurion, the issue is sprint charged him for something that he did not agree to pay. When sprint activated the ESN number did they inform him that their would be a $57 charge to activate it? Did the op have a contract with Asurion to pay the fee? If they did not inform him or have a contract then they have no legal right to charge him. It is not asurion fault that sprint allows them to bill customers that they do not have a contract with. In regards to the statement that this is policy, it would seem that is tough luck for sprint. If their is no contract between the op and asurion than they can not collect. For me personally it is my policy not to pay sprint for my plan, though I have that pesky contract that overides my policy.

Say I bought a Sony tv from ebay and hooked it up to my cable and then a month later my cable company had a charge from State Farm saying it was an insurance replacement and I had to pay a deductable I would blame my cable company not State Farm.
