If they did not inform him or have a contract then they have no legal right to charge him. It is not asurion fault that sprint allows them to bill customers that they do not have a contract with. In regards to the statement that this is policy, it would seem that is tough luck for sprint. If their is no contract between the op and asurion than they can not collect. For me personally it is my policy not to pay sprint for my plan, though I have that pesky contract that overides my policy.

Say I bought a Sony tv from ebay and hooked it up to my cable and then a month later my cable company had a charge from State Farm saying it was an insurance replacement and I had to pay a deductable I would blame my cable company not State Farm.
Throwing the idea around of someone BESIDES the person who placed the claim, paying the deductable, is blowing my mind. I don't think that is possible. If it is regular practice for insurance companies, someone needs to read up on the laws. If I didn't have a contract with Asurian, there's no way in hell I would pay that fee.
