If you return your Mogul and they find it to be non-defective they will charge you for the Touch Pro.

I had a Sprint store tech confirm my mogul was broken and they gave me a form stating that it was broken and that i include it with the returned phone. I used the website self-service rather than having the store do it for me. Mainly because I have heard the store hoards the TP's when they come in, even if designated for a customer replacement and then delays until they get a Mogul for the customer. Pretty shady, but it was confirmed by a store employee that I know. Yes, they will charge you if they deem your phone was broken beyond repair or is not broken at all.

I still can't make heads or tails of this line. If the phone was repairable then why would we need new phone. Why is it our problem if they can't refurbish it?
