I had a Sprint store tech confirm my mogul was broken and they gave me a form stating that it was broken and that i include it with the returned phone. I used the website self-service rather than having the store do it for me. Mainly because I have heard the store hoards the TP's when they come in, even if designated for a customer replacement and then delays until they get a Mogul for the customer. Pretty shady, but it was confirmed by a store employee that I know. Yes, they will charge you if they deem your phone was broken beyond repair or is not broken at all.
