Critical has already addressed these concerns in the old thread. At least I am pretty sure he did... He stated that he is allowed to discuss these things to a point, but cannot post pictures or video data. They (HTC) actually encourage these types of posts to help with user issues and product information awareness. So, no trouble for him as long as he stays in line with what he shares...

I don't know if anyone knows yet, but I've confirmed that Best Buy will of course have the Touch Pro in stores on the 26th of October. I can vouch for this post. That's all I stopped by to say. (Although I'm late as hell).
