That's correct, the Touch Pro was never mentioned. I think EVP's either bluffing, or the stores said they don't carry the Touch Pro. Or, if they were aware of it, they may be assuming it arrives after the discount deadline. But there is nothing written on the promotion, nor is there any logic that places the phone in a different category, that would suggest it's not covered by it.

So there is nothing written about BB being able to change the terms and conditions at their discretion?

I can confirm that the physical coupon only mentions the iPhone 3G. It doesn't say anything to the effect of "new phones" or any other type of limitation.

That's a whole other story, but it generally puts them in a bait-and-switch scenario. Coupon says all smartphones excluding iPhone, and that's what they have to stick to. "Oh, and that one, too" when you pick out another phone would get them in deep trouble.

Well they have to stick to their claims then. They knew before they printed that coupon that the Touch Diamond had a possibility of coming out, so they should have put in into the terms if it wasn't going to be covered. I have the physical coupon, so they have to comply with the terms and conditions of it. Since I didn't receive any notices in the mail that said they made a mistake, it has to be accepted.

Best Buy has no plans on making this coupon not work with the Diamond / Pro. Whoever anyone spoke to was misinformed. This coupon works fine with any smartphone except the iPhone.

The only reason it doesn't work on the iPhone is likely because of Apple's draconian control over anything relating to the iPhone. Price HAS to be $199. OMG NO DON'T JAILBREAK, and that app sounds like something we might do, so denied are two more of their ****ty policies that come to mind.

That, and the fact that it is NOT a smartphone, no matter what Steve Jobs says.

But yes, they're price-fixed. Best Buy's not allowed to modify their pricing at all. And you should see the control Apple has over their display in PCHO. Nothing's allowed to be placed against the wall, the computers aren't allowed to be locked down (a simple alarm cord, but NO locks), etc. Their power is incredible.
