In my post I linked to the thread that already exists for this purpose. It's in the Raphael board where it's more on-topic than a board about how to improve the Titan you already own and plan to keep. I strongly recommend that thread as it contains about 40x more information than this one.

I'm saying that the people who've successfully negotiated with Sprint to trade in their Mogul for the Touch Pro seem to all be under warranty with the exception of...

by the way, it does not matter how long u had the phone as long as you have insurance..in my opinion.
You did get lucky. I've spent a couple of hours in total with eCare. And insurance has nothing to do with it. Insurance replaces your phone with a refurb of the same model unless you're lucky and they're out. And even then they usually ship you the new model minus all accessories.

Honestly, I wish I could tell you some secret password. To tell you the truth, I listed my complaints about the Mogul, said I knew it was to be replaced by the Pro, and was offered the return kit and Pro credit. That's it man. No black magic, no secret handshakes.... I dunno. Seems like some have gotten the ok, and some have gotten shut down. I am on SERO, have EVP, and recently got some "premiere account" upgrade. I have no idea what the "premiere account" is, it just showed up one day when I logged onto sprint.com. That's the only think I can think would be the difference?

Yeah, I've got the Premier status (I think it's for people who've been with them over five years, but I see no benefits to it), but I don't have SERO or EVP. I think EVP qualifies you for some extra benefits, but still...

They shot me down....

Thank you for contacting Sprint. I am sorry to know about the problem
you are facing with your PCS Phone (HTC Mogul).

The handset is well within one-year manufacturer warranty. So, please
take your phone to the nearest Sprint Repair Store to get it checked.
The Sprint Repair Stores effectively handle your equipment and warranty
related issues.

If there is minor issue with the handset, the onsite Store technician
will rectify the problem. By taking your handset to the store, a
qualified technical service representative will test the phone to
determine if its condition warrants an exchange or a repair.

For your convenience, I am providing you list of few stores near your
home:
Like I said earlier I've been with em 8 years.

That's a shame. I'm working with eCare at the moment to see if I can get a discounted (or free) Touch Pro, as well. So far they've given me the $250.00 discount, but I've been a customer for at least 8 years (having trouble remembering whose service I was on before that), so hopefully that'll have some pull with them. I'm playin' it kind of dumb when it comes to the Touch Pro and stuff like that, so hopefully they won't suspect that I'm just trying to weasel an amazing phone out of them for free

I never mentioned another phone at all I pretty much told them how unsatisfied I was with it and how long I've been a customer.

I didn't play dumb about the Pro, in fact I asked if I could exchange for the Pro. I also mentioned I had been to the repair center numerous times.
