No, I had to go through insurance...the replacement of the replacement was also a refurb, but was in pristine condition.

i don't know why you hi-jacked this thread to stand on your soapbox and preach your opinions. but now that you have my attention, let's say you buy a phone. it comes to you scratched up but it works. now honestly, would you keep it and not say a word? and btw, htc who makes these phones has a ONE YEAR WARRANTY AGAINST ALL DEFECTS IN WORKMANSHIP and even they aren't sending refurbs.

Once again if its under 30 days its another story you are entitled to a new one. After that you fall into the warranty period which, if you read it your warranty sheet, says they will REPAIR your phone not specifically give you a new one. Sure, Sprint may be nice enough to give you a new one, but if not then you take what they give you because they are the middleman for the warranty service. Warranty period does not equal entitlement to a brand new in box device.

And no one hijacked anything, I already assented that the OP deserved a new one. But theres no need to promote fraud against anyone or any company.

maybe not but i have to tell the sprint techs what to look for because i learned it here first!

Hey, I just want to reiterate that I bought my Sprint phone about 50 days ago. Within those 30 days, with about 2-3 days left on my original 30, I decided to exchange it because my buttons were sticking. The lady at the Sprint corporate store told me they had none in stock, but Sprint would gladly give me a new phone once they were in stock because I had TEP, and to check back later.

I went to another Sprint Store a few days later and told them this, they told me they would order a new one for me, and give me an exchange. I called the following week and found out the phone was on backorder, so I called back again a few days later and it still had not arrived.

So now its 50 days later, and I have tried to do the online exchange thing, and I believe I deserve a new phone because the original issue was never solved while I was within 30 days.

no i understand ive already totally agreed with you there were extenuating circumstances in your case with out of stock issues. You totally deserve a new one.

Just other people who are promoting committing fraud in general cases isnt cool in the forum.

So you can confirm that Sprint is currently sending out new TP's and not refurbs? That would really calm me down on this issue. I don't care if its in the box, as long as the phone itself is new and has no issues. Heck if it is a refurb, but it works great, with no cosmetic or hardware problems, I wouldn't really care too much, but it is the principle of the thing here.
