I had the same issue. I had to get another phone. I live in Houston and the number was form San Antonio. After 3 days of programming, hard resets and everything else, i had to get another phone.

i almost bought from this seller yesterday but the price seemed too good to be true ($390 buy it now) and when i had finally convinced myself to do it the auction was pulled, heh.

I filed the claim only after they didnt follow up with me, as they stated they would, provided false contact information via ebay (I tried to obtain it, so I could call them, and discuss it in a more personal way, versus emailing), and the emails I tried to send, to their contact email address bounced.

In the claim I even said I'd be willing to immediately close it (which is indeed an option if you come to a resolution).

And I'm not outright saying they were ripping people off (I said it was a little hoaky, and I do understand that things happen). Either way, it's all taken care of now, and the phones on the way back to them.

They offered to exchange it. When I contacted them to follow up, the message bounced. I requested their contact info from eBay. Phone # was bogus. Tried to email them again via ebay, and never heard back, so I opened the claim. Stated at the very beginning of the claim that I was only opening it, in the hopes of re-establishing contact since my emails were being rejected, and their contact phone # was not valid.

Never even indicated a refund amount (paypal asks you how much you are disputing), and she completely ignored it, and just refunded me (like I said, that's fine, but why bother to offer to help, and then not do it.).
