i see a lot of arm chair lawyering but a lack of legal knowledge. Oral agreements CAN be held as valid, but as above, there is no consideration here if OP didnt resign because Sprint inccurred no benefit from the customer. So no, there would probably be no enforceable contract or agreement in any court of law. Pretty much hes SOL at this point unless he finds someone else there who wants to work with him, but i havent seen any reason why said yet.
And people wonder by Sprint is going belly up- because people are constantly taking advantage of the situation. I see a lot of swearing but not a lot of info why OP feels justified that he has to be traded up or threaten to retentions, which is a lame move IMO if its just to threaten to get what you want. If youve been through 6 or 7 moguls thats one thing but you feeling like you deserve a swap means absolutely nothing, and they dont HAVE to authorize it what so ever. |

well u can try to get someone else to work with you, but pending they will not, figure it this way:
sure you can go get an iphone or G1 for $199, but youre also paying how much more per month times 24 months? Then take the amount for a pro either full price from sprint or on ebay and subtract what you could sell the mogul off for and youll have a price. Is that lower or higher than your savings in the 2 years? Id be willing to bet that youre saving a lot more monthly than shelling out up front though. Say youre saving $20 a month, youve accounted for $480 of that price difference in phones in the 2 years you would sign with a new carrier- almost the full touch pro price, not counting if youre saving more per month than just $20. Everyone in this thread blows me away. Why do you all feel like you can get something for nothing?? Like you should be entitled to the latest and the greatest for cheap or free??? Are you that greedy and self-centered?? If you want the touch pro that bad, here is a hint ... buy it for what they are asking ... instead of trying to work the system. If you don't have the money, then tough ... save up. I read about how people cheat the system over and over again and it makes me sick. It is dishonest taking advantage of Sprint in this manner. I had only one PPC6700 and one Mogul and they both lasted me with no problems. I find it hard to believe that people have exhanged these phones 5 or 10 times. Sounds like a ploy to get a new one to me. I hear people talk in these threads. Sprint loses money on every one of these that they sell as it is. No wonder Sprint is in such bad shape. You will eventually screw it up for everyone! What will you do when Sprint goes out of business ... go rip off Verizon or ATT?

I agree that its not right to do some things people are mentioning, but that thats not the issue.
Sprint is going back on their word. Regardless of who it is, that is unacceptable. $500 phones not lasting for more than months is unacceptable. [Assuming standard use] And you sound as if EVERYONE is doing this... Yes, they do lose money, but not on the scale that you're implying |

I just find it hard to believe that it is just the small amount of people doing this that you mention. What about the rest of the population? I read it again and again how people cheat the system. Eventually, it is going to catch up to all of us. It makes it hard for the legitimate people with true problems with their phones. You are naive to think that Sprint doesn't read these threads and knows what people are doing. Yet they are forced to give these people phones or they have "poor" customer service.
