And people wonder by Sprint is going belly up- because people are constantly taking advantage of the situation. I see a lot of swearing but not a lot of info why OP feels justified that he has to be traded up or threaten to retentions, which is a lame move IMO if its just to threaten to get what you want. If youve been through 6 or 7 moguls thats one thing but you feeling like you deserve a swap means absolutely nothing, and they dont HAVE to authorize it what so ever.

Your right, I didn't post because I was kind of pissed and just wanted to vent. Im not considering legal action nor do I think the email is legally binding, its the principle Im fighting on.
My reasoning is what you said, Ive been through 4 Moguls and it was a sprint person who told me I could upgrade if I did X.
my reason for threatening to leave is I need a working phone, thats the end of it. I haven't had a phone that has functioned to how sprint and HTC has said it would and I paid retail for it. Hell, I could get a G1 or an Iphone for half the price and half the hassle.
