Very interesting. Your case is similar o mines. Bought a new Pro and had the oily screen deal after 2 months. Then got it replaced free on my Sprint repair store, got a refurb and was kinda unhappy but oh well. The a month later the KB stopped working. Had it replaced and got another refurb. Then that refurb picked up the oily smudge on the screen and had that replaced and its going good so far.But its been only 3 weeks with it. I do have time to visit the Sprint store for these fixes and never paid a dime to get them replaced but I did get really bummed out that I paid 349.99 dollars for a NEW device that lasted only 2 1/2 months and later replaced with a used one. So I paid a lot for a used phone. That's what bothered me personally. I have not contact Sprint about this but everyoe in this thread is making me think now.

this is why people say sprint customer service sucks. HTC made the phone for all carriers, but its only sprint customers who swear they should be getting free tp2s for replacements the exact same day the phone comes out. Of course Sprint is going to say no when you ask for that. If you ask me you don't deserve that. my tp1 was replaced a lot also so i got a tp2. All the problems you are having are with the manufacturer because they built the phone. Obviously you're mad at HTC but you want sprint to replace your tp1 with another HTC phone when you obviously just had bad vibes with them. if you're upset your tp1 is soooo defective why would you want sprint to replace it or as the op said he only wants a discount on the new phone, just doesnt want to pay full price. So basically he's even still willing to pay some $ out of his pocket but yet he doesn't like htc devices because they break down and hes had like 8, why would you want to buy from them again, so when the tp3 comes out you can start the complaining all over again?

I'm not sure why you would have accepted a refurbished device on day 4 of owning it. Either way, you're far from the only person this happens to, it isn't the only phone that has issues like this, and it isn't the only carrier. That's what you have TEP for. I'll say it again. TEP IS NOT MEANT TO BE AN UPGRADE PROGRAM. The keyboard issue has nothing to do with Sprint. Last I checked, HTC built the device, yes? Sprint is doing you a huge favor by, after 30 days (and via TEP), swapping devices for you so, at least for a little while, you have something that works. No one OWES you anything.

I wouldn't consider Sprint doing what you pay them to do via TEP a favor.

Guess I should have worded myself better. The fact that they OFFER TEP is the favor I'm speaking of. If I remember right, some carriers don't allow any kind of insurance on smartphones (but I could be wrong on that one if anyone else wants to chime in on that).

Edit: Also, if you remember, Sprint reserves the right to replace it with something they deem "comparable", which in some cases is an upgrade, but in some cases users might end up with something many would consider a downgrade (maybe a never device with no keyboard, less memory, etc.). All I'm saying is, if they really wanted to stick it to people, they could stop offering TEP, and after 30 days, if your device is defective, you mess with the manufacturer, in this case HTC.

First of all, I don't have TEP. I don't need tep. I purchased a New phone from sprint. I paid $400 to sprint, on 7/9/2009. Sprint mailed me a new HTC Touch Pro. The box said sprint on it. The phone Said Sprint on it. The software on the phone said sprint. I'm not able to take "my" sprint phone to another carrier and use it there. The phone, regardless of who manufactures it, is a SPRINT phone.

Therefore sprint is responsible. If I had purchased the Phone from HTC I would be expecting HTC to issue me a refund. However I didn't, I purchased it from sprint.

Then Sprint replaced my NEW phone with a refurbished one that is too old for the HTC manufacturors warranty to cover. So by doing so they absolutely assumed responsibility for my new warranties, considering They have my new TP, and I have an old broken touch pro that they took from someone else.

Sprint owes me at least a full refund. Although, I'd settle for a new phone that actually worked. The problem is, sprint is only willing to offer a Significantly cheaper "new" phone as a replacement and that new phone doesn't even have all the capabilities of the new phone I purchased from sprint.

If Sprint was a new car dealer, and you bought a new car from them, and on the way home it broke down, you'd expect them to fix it right? So, if instead of fixing it they gave you a new set of keys and said, oh don't worry, here's a replacement car. And when you got in it it was an old beatup used car do you think that would be fair?

Cmon now...

I just joined this forum and I'm already considering leaving... what's wrong with you people?

Deadsteam, I'm with you 100%. Your car example is exactly what I was going to post as I read through this last page. I still think some posts do get excessive with all the claimed phone issues, but I can see where 3 or 4 keyboard issues is very plausible. I'm going through the same thing. Sprint should be able to look at my track record and see that I've only had two replacement phones in 15 yrs. And 1 was only 3 weeks ago. It's just aggrevating when you honestly just want a phone that works. I don't even want sprint to upgrade me to a TP2. I really don't expect them to. I just want a working TP1 so if I sell it, I can do so with a straight face and not screw someone else!

When you buy that new car and drive it off the lot it is used. Even if you turn right around and try and trade it in you will not get what you just paid for it. Secondly, and I don't even use Sprint, you purchased a HTC. Sprint doesn't manufacture the phone, they provide the service. If you want another TP I am sure that they will give you one, but if you want to change to a different phone, well that is like trying to trade in that new car after driving it for a few months. Sorry, but the world doesn't work that way, wish it did, but it doesn't.
As far as leaving this site, personally I think that you would be making a serious mistake. The people here are only trying to explain to you your options, not kick you in the nuts. We are all sorry that you don't like your options, but those are what you get to choose from. From what I can tell in the two posts that you have made so far Mommy gave in whenever you cried, but that is just my observation. I could be totally wrong. Maybe it is that you just got off the phone with Sprint and learned that you are now stuck with a phone that is outdated with the release of the TP2 and you are pissed off about it... If that is the case, well maybe you will do a little research next time before you decide to make a purchase. I know that I knew all about the TP2 back in July, sorry you didn't!!

First off, I'm loving my TP2 so far, HTC may have redeemed themselves, but we will see...I think what a lot of these people are missing is that, unlike a used car, or whatever analogy, cell prone providers here in the US are legally allowed to force and dictate the choice of phone here. Sprint gives us a, b, c, x, y, z, phone. They do not manufacture it, but they choose it, test (maybe, definitely not enough) it, then distribute to their customers they have locked by CONTRACT. If they give you a lemon, obviously, they have to take at least some of the blame, I didn't go to HTC and say "I want that one". We already know they are behind the times and CDMA, monopolization, carrier locks and FCC issues get us americans old technology. Maybe it has to happen to someone to understand...

I'm nio legal expert, but I'm sure this would open Sprint to all sorts of legal trouble, or they would have to -gasp- test and verify equipment for use on their CLOSED network is good. Can you imagine the lawsuits they would catch if they sold a defective device with no policy in place, the had the nerve to charge ETF for leaving? Total ****storm.
