Unfortunately, again these methods, theories, and tactics are not guaranteed to get you a new device. doing things by the book are the best way. Granted, i wouldnt mind getting a bit of a discount myself or a free device here or there. But when you think about it, it is not the service providers responsibility to give you a new phone for every minor issue. We provide you with the service and an array of devices to choose from. I dont mind helping customers out, but it really burns me to see customers try to get something for nothing! or try to work the system. But as soon as there is an issue with the bill consumers have a complaint! not to get off topic but again, the best way to get a new device or replace a device is using your TEP (that most people refuse to pay but still want a free phone!!!) or use your upgrade. UNLESS THE PHONE IS WITHIN WARRANTY! within 12 months you'll get a replacement phone NEW due to manufacture defect, and for those who get lucky in the store with the techs its just purely luck! doesnt happen too often lol trust I tried before I as an employee at Sprint.

My luck has usually been good at the store. You need to make sure that you go to a service center, which is really just a BIG store. But these are company stores - NOT authorized retailers or kiosks at the mall. If you have TEP and the phone is less than 12 months old (the original factory warranty) the store will replace it for you with whatever they have in stock (new or refurbished), assuming it can be chalked up to a defect in the phone. If it's within the 12 month warranty and you DON'T have TEP, they can tell you that you're only recourse is through the manufacturer directly. I was told that policy started a couple of years ago, that the stores only honor the first 30 days of the warranty unless you have TEP. If you're out of the 12 month manufacturers warranty then TEP is your only option. They don't care why it's broke, but at that point, the $50 deductible comes into play. I do know that TEP is not obligated to send you the same exact phone or the newest replacement for your phone (i.e. the Diamond to replace the Touch); they only obligate themselves to replace it with a comparably equipped phone. Trust me when I tell you that your Mogul can easily get replaced with a MOTO Q9. They will not guarantee the model that they will send you, although I have only had one instance where they sent me something other than what I had before. Your chances of getting a brand new unit from TEP is slim to none, although they do a decent job making the refurbs look new. The key at the store has been repeated here several times: DON'T BE AN A-HOLE!

Run it over with your car. Of course, back up your contacts, etc first. Saying it's scratched isn't likely to get you a new phone. But, stick it in your carrying case and run it over with a fairly light car. This should do just enough damage to break it so that they don't try to find out you modded it, but it shouldn't really break it to pieces. My phone got runover like that one time and the screen was cracked, but nothing else - I could make and receive calls and stuff.

I always get a new phone as well. I take it to the repair store. Just took this first Mogul a few days ago. I wore the thumbwheel out, and the styli won't stay in. New one is on order. I was hoping they would trade it in store for a Touch, but no such luck. As long as I take it to the store, I get a new one. If I call it in to CS, I usually get a refurb. So now I always take it to the store. I have never paid the 50 bucks, either.

I had the same problem. I pondered the following 2 options.
1. Just tell them I lost the phone. Pay the $50 deductible and a brand new phone comes in the mail. 2. Take it back to the store, convince the tech it was a manufacturer defect and they will order you a brand new one or replace it on the spot if they have it in stock. I have done both and both work. For option 2, i just took a nail file and popped off the piece at the top the messaging and IE buttons underneath. the tech saw it was constantly falling off. The rest was history. Anything considered a manufacturer defect get replace free of charge. All others get the $50 deductible treatment. This is all assuming that you have the proper insurance coverage in place.
