i will once again pose my original question which i have asked several times, simply end all this by addressing it: (My only issue is with sprint tv/radio). I pulled out the box my mogul came in last night. On the back of the box was a pic of a spint music store screenshot, plus a screenshot of on demand. I don't remember the exact wording, but the box infers the ability to download and listen to music/on demand content on the nations best broadband network. I also had the original copy of the "powervision" plans, and options that are included with the three different plans. Canospinach is correct, in the fine print is a statement that some features are not available on certain pda phones. This summer, when I purchased this handset, I had an aparent mis-communication from the sprint store sales rep, as I was told the mogul could access sprint tv/radio. When I could not find the sprint tv program on the handset, I even called tech support, and they spent over two hours trying to figure out why sprint tv/radio was not on the phone...and the next day they suggested I purchase mobitv. I also researched the mogul prior to purchase( I bought mine in the middle of the summer, cant remember if it was june or july) and received info from sources such as this: http://www.networkworld.com/community/?q=node/16326 "And yes, the Mogul will be able to play music and watch videos. I know this is not an official sprint publication. I agree with Canospinach, legal action is probably a dead end. But my issue is customer service related. I felt I asked the correct questions regarding sprint tv and radio directly to a sprint rep. Maybe the rep was not properly informed of the features of this handset, maybe he just wanted to make the sale. Seeing sprint tv and radio on the Touch just poured gasoline on my fire. EDIT - Bottom line, the question above is key to the merit of the lawsuit. IF you cannot provide verification to the claims, then the lawsuit would appear to be lacking of merit and validity. Clearly then the light that this is simply an extreme dramatization begins to appear when evidence for the specific claim cannot be manifested.

On November 25th, I installed 2.17 with 1.47.01 radio and PRL 60611. I've used this configuration since that date (no hard resets, and I soft reset on Wednesday and Sunday mornings):
-- Windows Live (Live Messenger signed in when mobile, mail syncing every 30 minutes). -- Office Mobile 6.1 for viewing attachments from my work email account (Exchange ActiveSync, every 30 minutes). -- Personal Email syncing via IMAP every 30 minutes. -- Windows Live Search Mobile and Google Maps Mobile for directions, theater info, and general searching. -- I send about 2 dozen texts per day. -- I take photos on occassion. -- I use HTC Task Manager (X-Button) 2.0 for memory management. -- I use AIM 2.0 on occassion for instant messaging. -- I make a boat-load of registry tweaks for settings. -- I even use Remote Desktop to connect to servers at work. -- I make a few phone calls during the day/evening as needed (yeah, this seems obvious). -- I manage my task list, contacts, and calendar via ActiveSync/DirectPush. So OK, there's no good way to send pics via text message (it is called text messaging, right? I can send via email, however.) When I looked at the specs from Sprint, HTC, and Microsoft for the Mogul, at no point did it ever suggest that GPS would be offered. Only after I bought it in early October did it become "official" that it would be an update later (sweet-- bonus features). I pull the phone off the charger at 8:00am every day, and when I plug it in at 9:00pm it is still in the 80-90% charge range. I've knocked it down to 60-70 with a lot of calls earlier in the week. Now don't get me wrong, coverage areas will wreak havoc on battery life by causing the radio to work a lot harder. I turn off wifi and bluetooth and beams, because I don't use them very often. I turn them on AS NEEDED, however. I just stopped by a Verizon kiosk yesterday with my mom to look at the Samsung i760 and the VX6800. The specs are very comparable, though obviously not identical. Now don't me wrong, I know that 64MB of RAM isn't really enough. I know the faulty firmware in October was annoying (it bit me too), but they corrected many issues and are correcting more soon. They're even giving bonus features like GPS that were never originally promised (I know a handful of you claim otherwise, but you haven't documented that very well). How, then, is this lawsuit legitimate? What features are missing that other phones have? Picture messaging? OK, but it was never promised. GPS? OK, but it wasn't promised and is coming anyway. Am I missing something? EV-DO Rev. A? OK, but it's coming. Yes, I'll grant you that it's late from original estimates, but I'm sure they weren't expecting the Oct. firmware glitches. Please, oh please, fill me in. I was promised 64MB of RAM. I got it. I would love to have more, but I got what I paid for.

PS-- I'm not saying you're not having issues with your device. I'm not even implying that you don't have the right to complain. I just think your actions are incredibly irresponsible and petty, and more importantly, this forum meant to help people SOLVE problems, not create more problems, nor should it be a party for whining.
What I really think you should do is get Sprint to either give you the phone that you really want that will accommodate the needs you expect, or to drop your contract so that you are free to move on. I believe that technology should work for you, not make you work for it. Clearly you feel the Mogul makes you work too hard for it. I get it, but you made a choice to buy it. You had 30 days to change your mind, and now you're whining about the mistake. It's time for you to own up to your responsibilities and do the right thing... or at the bare minimum, prove to us that your complain is valid by documenting your case thoroughly and accurately. |
