At first your are just going to state your proof for example :

The item was not sold as described.. Seller did not include the fact that he would be filing an insurance claim through Asurion, which is the cell phone insurance company for Sprint , Verizon, Tmobile and ATT. I have actual live proof including shipping receipts showing account information for another sprint customer plus my name, name on the shipping box , and included envelope from Asurion to return a defective phone... etc etc....


I have already included these items with my dispute with Paypal so I would not have to worry about them later.

That's tenuous, is it not? I was promised a brand new phone, and I received a brand new phone. My main concern is having someone else get screwed through my transaction. Obviously, I had no idea this was even a possibility until AFTER I received my phone or I would have never purchased it.

Right now I am just protecting my arse so I do not get screwed over in any way possible. So as it stands I am taking every protective measure I can.

Technically, my auction read 'Brand New in Box HTC Touch Diamond, CLEAN ESN'...

And that's what I got. The grey area I would say is in the ESN...does Clean mean not stolen? Is a fradulently acquired phone automatically stolen ESN?

There's no question, IMHO, that something is not on the up-and-up. Shipping straight from a Sprint warehouse from a guy with 15 feedback? Getting a different MDN # on a packing slip, and a different number listed on the mailing label?

I've been in contact with another guy who bought from lk, and he got the same number on his mailing label that I did, which is some poor guy from KS.
