idk id say that really depends. in my case they wanted a receipt since they saw it wasnt an order from telesales/online, or some proof from a store tech it needed to be replaced. Seems theyre getting away from trusting customers at will that they need to be swapped. the executive services rep said theyre having a lot of problems with reps giving away phones as swaps just because the customer says so and the rep trusts them. Seems liek theyre clamping down the restrictions.

True, it all depends on the rep you get and what issues they have had lately with phone swaps. I say try it, whats the worst that will happen, they say no?

I have been using Sprint for almost a year but got quite disappointed at
the phone I'm having now. Currently I'm using Sprint Touch by HTC, to be
frank, I like the slick and thin design although it does lack of
physical keyboards and that's the reason I still stick to the same phone
after it failed me for such a long time. I've got several problems with
this phone. I've exchanged the same phone but so far I still haven't got
a single one without any tech problems or defects. The handset I?m
using now was activated in March this year. So far it has got three
major problems: limited viewing angle (everything grayed out if viewed
away from center): waterwave pattern on the screenonce the screen is
pressed which caused a dark smudge on the screen.

Recently the screen has a rainbow like pattern permanently staying in
the center of my screen. And that mark is becoming bigger and bigger. I
attached a picture in the attachment. Please take a look at those. I
have two friends who has a Touch since April this year and November last
year respective and both had the same problem lately.

I am not going to a Sprint store because I had really bad experience
there every time and I swear I am not going back anymore. Please see
what you can do and let me know. I appreciated your help.

Do you have insurance it doesn't sound like you do? If you have TEP they have to replace your phone if it only with another touch than thats what there gonna do we all all just hoping that some of us having issues with our moguls because they are the same MSRP and being replaced through insurance with sub-par refurb's can push the point that we deserve a new handset rather than refurb'd and the mogul is not available new as they say they dont have them in the warehouse. I am going to keep complaining about the refurb I just got because i truely feel the refub they sent has issue I just hope they will bend on the policy where they have the right to just keep giving me refurbs as long as it takes to get a good one in my opinion

I don't have TEP and actually have given up emailing ecare for a good Touch for quite some time. Our touch either have the waterwave+crappy screen or the rainbow, and there was a thread discussing good screen vs bad screen. I'd say 90% of touch users end up with a bad screen even after several exchange. I was about to wait for Touch HD next June when my contract expires, but one of my friend actually squeezed a Diamond as replacement for his touch from last Nov (he's got no TEP either), all free of charge, which made me want to try out my luck again.

Keep trying with the emails, dont take no for an answer, and keep stating the same reasons you are upset over and over again. Give this a try for a few emails and if it still is a no go, try retentions and threaten to cancel. Sometimes they will try and call ur bluff, so asking for ur account # to take your number elsewhere is the best play to make them believe you are serious

I tried and the best I got was returning my touch and getting credited. Which isnt too bad since I can buy the Diamond for 349-100MIR so I essentially get it free over the course of my bills from the credit.

thats not too bad, about what they have been doing for us mogul user, so i would say it could have been worse !!

So I ended up getting the Touch Diamond Friday in exchange for my defective Mogul. When I called to activate it, they told me they had to open up a case and I would need to wait 72 hrs until they released the ESN so that I could activate. In the process of CS ordering my Diamond, they put me on a simply everything plan. My wife ended up calling and got that straigtened out and rather than our normal $95 bill we have a $5 credit next month. I also had the rep check if my account was noted that I would be getting the Touch Pro when it was released in exchange for the Touch Diamond. She said, "No it isn't, but it will be, give me a second." She then told me to call back to place the order for the replacement on Oct. 19. Thank you, bye. I hung up then proceded to mess myself.
