I contacted Sprint for comment last week. Most importantly, I learned that the Simply Unlimited plan is not affected by the data usage cap, which applies only to connection card and phone-as-modem plans. Here's what else the carrier has to say about the new policy.

neither of these examples are the same, the crime I am referring to is only punishable IF the other party presses charges. your examples do not have the same prerequisite. so i can tell someone how to keep their woman's mouth shut, and if these tactics work and she doesn't call the police then noone is prosecuted. the neighbors can call the police, but it is up to her to press charges.

Re: Warez Vs. Tethering

uhoh, this thread has turned into yelling match on the internet. The problem with the thread is that crazychef keeps on diverging from the OP.

The OP asked if ICS regedits should be considered warez, and therefore be banned from the site. I think from a legal standpoint, they are not one and the same and therefore PPCGeeks do not treat them the same. If the OP's point was to say that ICS regedits are warez and a bannable offense, then I would say the general consensus is that he is wrong. Diverge any further than that OP and this thread just become a war of words and no one knows what the hell they're arguing for or against anymore and eventually it just turns to personal attacks.

Re: Warez Vs. Tethering

i love ya for fighting your fight.. but you knew you were gonna get a response like this..... i made sure the best went last, and i sized it up abit in case you might miss it..

are these places wrong as well??

http://www.evdoinfo.com/content/view/2343/64/
UPDATE 06/19/08 Sprint has started contacting approximately 5000 data card and phone-as-modem (PAM) customers who are exceeding the 300 megabyte roaming restriction, to educate them on the change in policy that they were notified about via message in their monthly billing

http://www.boygeniusreport.com/2008/...ited-data-cap/
First off, the new cap only applies to data cards and tethering,

http://nextelonline.nextel.com/en/legal/legal_terms_privacy_popup.shtml
first, Data: Services are not available with all Sprint phones. that means if your plan is not compatible with a PAM plan, oh well, doesnt mean steal it.

second ..Services are not available for use in connection with server devices or host computer applications, other systems that drive continuous heavy traffic or data sessions, or as substitutes for private lines or frame relay connections. Except with Phone-as-Modem plans, you may not use a phone (including a Bluetooth phone) as a modem in connection with a computer, PDA, or similar device.

and lastly,
Data Usage Limitation (Mobile Broadband Cards, USB Modems, Embedded Modems(im pretty sure ICS would be considered the "embedded modem" and Phone-As-Modem): The amount of data transmitted over our network is measured in kilobytes (KB), megabytes (MB) or gigabytes (GB). Sprint reserves the right to limit throughput speeds or amount of data transferred; and to deny, terminate, modify, disconnect or suspend service if usage either exceeds (a.) 5GB/month in total, unless specified otherwise or (b.) 300MB/month while off-network roaming. 1024KB equal 1MB. 1024MB equal 1GB.

here:http://www.phonescoop.com/news/item.php?n=3033 this took effect July 2008

Sprint is updating its Terms Of Service starting in mid-July and will be capping mobile broadband data usage at 5GB. Previously, Sprint offered truly unlimited mobile broadband. Once the new Terms Of Service go into effect, users who go over the 5GB cap, or a 300MB roaming cap, will be charged extra fees. This will apply to both network cards as well as tethering mobile phones to laptops. AT&T Mobility and Verizon Wireless currently offer 5GB data plans, also.

Ok thats is wrong (nt accurate beyond a doubt).

My account with the U727 usb air card is not capped at 5GB.
New users who are not on a business account or corporate, may come under this.

This "cap" isn't universal. I frequently go over 5GB a month on my Unlimited account with Sprint. And my contract is honored to do so without scrutiny.

I can verify this.

700MB+ over and counting. No alterations in my serivce & this is the 5th month in a row that I have done so.
