Check your serial number. Mine is 845Hxxxxxx. This denotes week 45, 2008, which matches with my November 6 build date.

Would i be able to get a new phone is the key board is shaking the buttons on the front are raised and the picture mail still does not work no matter what sprint tries to do.

Due to the demand, and limited availability of the TP I'm not sure if they would do this, I have been waiting for my exchange for over a week now and mine was due to the known defects in the early batch.

Great news I just got off the phone with sprint. My TP is still under manufactures warranty and it had defects not big ones but none the less there are some defects. I should have my NEW TP hopefully my the end of this week with a return kit for my current one. I hope all goes well with the new one. And if anyone wanted to know my build date was 10.19.08 and i activated it on 10.31.08
