My guess is someone tried to flash a custom ROM, go to the olipro part, freaked that it was a bootloader, then did an exchange. When the factory got the device back, they just reset it, back into normal mode, then said the device was ok to be sent as new.

exactly, but they only get "tagged" refurbished if they actually take it apart and "fix" something..

i think what he meant was he should charge Sprint for distributing their product with his program preinstalled... no matter how it happened they are liable in some form or another for what has happened because either 1 they lied and this is not a new device but instead a refurb unit... or 2 they knowingly are distributing new units with it preinstalled... or 3 one of their sprint employees is knowingly distributing it without their knowlege which still makes them liable... those are the only 3 scenarios i can think in which something like this could happen... what i do know is that Olipro isnt getting credited for his work while a company profits from it's use...

mine was brand new in box with all accessories the ruferb status is no and life timer was consistent with my actication in epst

I got my brand new Mogul directly from Sprint online on Tuesday (five days ago) and it too already had 2.40 Olipro already on it. Confused the hell out of me.
