This is actually very simple. If you're still within your first 30 days, then it's Radio Shack's responsibility, in the event that it is just a manufacturer's defect, which it appears that it is. If it is outside of the first 30 days, then it's on Sprint.
If you're still within your first 30 days, then politely, but firmly explain to the Shack rep, that it is their responsibility to replace the device in the event of an equipment issue. If the rep continues to push back, then it's time to ask for a manager.

Right on thanks, I'm heading to Radioshack right now they can give me a new phone when they get their next shipment instead of selling it to a new customer... I think they just wanna throw this phone off the shelfs with sales not replacements

I had a similar experience over the phone earlier today. I called about my speaker making sure my insurance was in tact and she tells me that she can make me an appointment and then goes onto say " even with the insurance I may have to pay $150 to have it repaired at the store or I could buy a new one for $300." I told her are you frickin kidding me I've been a loyal Sprint customer for 12 years and that's how your treated. Nothing I tried worked and in the end all she could say is sorry can I make that appointment for you now. Guess i'll be fixing my own speaker

What does your speaker sound like? I found that if you press down the battery cover too much it causes static on the speaker. This may be caused by your cover and or skin if you have any installed.
