I'm in the same boat. I just bid on one and did "ask a question". I told the seller that if I purchased a phone, I would put the following verbiage on my PayPay payment -

"By accepting this payment you agree that the phone was not obtained fraudulently and that the phone's ESN number is clear and ready to activate. If you cannot guarantee this, please reject this payment."

If he responds that he will accept those terms, I'll buy it. At least if there is a problem, I should get a refund from PayPal...

Yes this person 2k9cantstopme has the same wording as the name 2k8vegasgoin who just got booted off Ebay. It definately is the same scammer. He is doing Diamonds for $224.99 and i'm sure most people will buy after reading this anyway and turn a blind eye just to get a dirt cheap "crackhead" price. Everyone here should report them to Ebay immediately. If you click on his auction and scroll down to the bottom you will see a link under Other Options that says Report this item. He is already getting sales and scamming new people. His auction says he has 100% feedback and right now its at 0. He does not even bother to change anything. Ebay has removed his old auctions so now we can't see to compare them to his new name. Ebay is definately part of the problem by now letting us see and compare the verbage from his old Ebay user id. I'm sure this guy has many user names on Ebay right now. Ebay needs to have some type of querry through PHP or run some type of SQL script (I know its geek talk ) to catch the same auction from a previously banned seller suspected of fraud. THIS PERSON IS A TRUE SCAMMER & YOU WILL BE A FUTURE FRAUD VICTIM!

First off, no one has proven without a doubt all of these transactions are a product of fraud. As it stands right now, it's all a bunch of speculation by posters on an internet forum. Sprint and Asurion dont know their arse from a hole in the ground, look at all the past scams that have happend between Asurion and Verizon themselves.

In short the same thing is happening again, as for people coming here posting information about what they think might be happening , everyone has their right to do so. They need to protect themselves in the event it is proven to be a scam, better to be proactive than to sit back and get hit with the worse.

With all the information floating around plus speaking to Paypal securtiy myself (Both people I have spoke with at PayPal security agree that it is definately some kind of scam) I am NOT taking any chances.

That's fine, and guess who that falls on? I'm not saying don't protect yourself, however saying completely innocent third parties will be prosecuted for being in possession of stolen property is ridiculous, think about all of the people who have received these phones and don't even post on here.

And what in the hell does Paypal know? I find it ironic you say Sprint and Asurion not knowing shows no credibility, but when Paypal, a company that has nothing to do with Sprint or Asurion, agrees with you everything must make sense.

Unfortunately someone still got you. Users on this forum such as reconboy are telling people to keep the suspected fraudulent items and request your money back from Paypal (thus futhering the fraud to the end and now scamming Paypal). "He said Paypal in NO way will loose money." Gues he thinks businesses such as Paypal that get scammed are doing great in the recession. Good thing dcperdue set him straight. Paypal looses millions a year due to Ebay fraud. Well Ebay owns Paypal anyway so Ebay looses millions.

I already contacted the seller to revise it, she has to initiate the request.

As far as getting money back from PayPal, the only way I see that happening, is if the device is returned to the seller. PayPal certainly isn't going to let the buyer keep the item, and get their money back.

I know it sucks for those who are going through this, trust me, I was there. It took me many many calls and hours of my time to get my situation fixed.

I think that the people who DID get stolen/claimed phones, should be worked with, with Sprint/Asurion, but, likely that's not going to happen, because both companies are boneheaded, and would rather just act rashly, and not think first. I'm all but sure there's going to be alot of phones turned off, which I think is unfair, but, like I said, that's Sprint and Asurion making those decisions.

I just received the number for the fraud department at Sprint. If they are open today, I am going to call them repeatedly until someone listens to what I have to say and takes me seriously. I have no idea why Sprint would not be interested in something like this, the 3 people I talked to there seemed to think I was insane and that such a thing could never happen. Honestly I'm not still fully convinced it is happening the way some are postulating it here, so hopefully I will get some concrete answers later on today, and if not, sometime later this week.

Good luck, I had the least cooperation from Sprint, and the most from Asurion, however neither of them seemed to express that they were going to do anything about it, and acted like it's the first time it's EVER EVER happened.

You are not fully understanding the concept , Seller never had possession of the Item , it shipped directly from the Sprint Warehouse here in Louisville. The seller is located in another State.

The item said is now on my account, which the IMEI is registered to now and not the intended account per what Asurion would thinking it would be considering its being claimed under someone elses account insurance.

NOONE has set me straight, and NOONE has to follow what i say but I still advise to use caution. Everyone here can think for themselves on what they need to do.
