Call the Better Business Bureau. When Sprint charged me extra for a mistake they made I filed a claim with the BBB and they gave me money back within 2 days. You can file a claim online.

I'm on day 25 with my diamond, all I can say is that I have no problems with mine. none. Whatsoever. except the usual bad battery life, low volume( fixed with audiopara), etc. Chit guys, goto buzzaboutwireless.com and read the complaints about the instinct. If yall think you have problems....It's nothing compared to them!!! I just read and laugh. I had my instinct 15 days and returned it. It's a waste of good plastic!!

I wouldn't even give the instinct to mom. As many times as mine crashed and locked up, I think by the second crash, it would be in tiny pieces scattered all over her house! BTW, I just tried pic mail for the first time...EVER! and WOOHOO!!! Went flawless. Sent a full 3.2 megapixel pic (I know it scales it down by default) to my wife on her Sanyo 8400! It only took 20 sec. from saying sending to sent! I'm in awe. Something actually worked the first time for me....now if only my doctor and aflac could get chit straight, i'd be a happy camper!!

I got mine a week ago and am already on my second one, which I have issue with now as well. The screen isn't properly seated and I have a white glowing edge down part of one side of my screen.

I have not had the chance to get my hands on the touch pro, but as of right now I am considering it and hoping the release date I was given holds...so I can swap out within my 30 day period.

Well with PIM Backup why don't you just copy the file to your computer and resync that folder after you're done? Meaning prior to returning the device copy the backup then go to the sprint store, after you get your replacement come home and copy the file and run the program. Voila all your contacts, also you can ask them to copy your my documents file over some stores are nice enough to do it.
