Well I sent emails to sprint.. seeing as how i've gone through at least 20 moguls in the last year and have been a customer for about 8 years.. After about 5 emails, they finally agreed to cover $249.99 and use my $150 upgrade and the mail in rebate to cover the phone... I told them that I want a return kit for my mogul and am not willing to accept otherwise or else I'm leaving them for an Iphone 3g at AT&T. So we'll see how they handle this one....That was at about 5:45 pacific and I haven't received a reply since.. all my other ones were about 30 min responses. I am hoping to leave my Upgrade in tact so I can move to the Pro.

It took two days and about eight emails back and forth to ecare, but I just got this:

well i just went to the store and got my mogul exchanged for a new one, no i all i need to do is wait a a week or so and send my email.... for the 30day exchange..

I just received another E-Mail from a different rep at sprint telling me the same offer, basically saying "This is our final offer".. 150$ off for upgrade, $100 MIR, and a $249.99 credit. The only difference is before I got to keep my Mogul, and now i get to keep my mogul (a little sarcasm eh? it was actually in the EMail).

Sigh i sent a reply.. i guess i'll see how it goes

I am in the same boat as you, just lost my mogul got a replacement today, so if i use it and e-mail sprint back and fourth saying i am unhappy with the replacement you think they will do what they did for you? Could u please e-mail me your emails back and forth so I may use your wording and such... Ur help would be greatly appreciated.

hmm well in 3 years with sprint i have straight SERO, no freebies or add-ons, and had one device swapped out (a bad mogul for a touch back in Nobember) with a return kit so id say my record is pretty clean.

but like i said i didnt call in to complain about give me a different phone i called in to troubleshoot the 800 and the Sprint tech was the one who told me it needed to be swapped and noted the account- i didnt ask for it per say if you know what i mean. Id totally understand their point of view if i called and said i hate this swap me just because, but it surely was out of my power the warehouse had not one 800w in stock at the time to put the swap through and i had to wait, thats a detriment to me having to hold onto a bum device they couldnt fix or swap out, which i didnt even ask to be compensated for my inconvenience. The only thing i did ask for out of them was the diamond instead of the 800w, but i cant see that being a detriment or unreasonable to them as its what $60 cheaper and i told them i dont care about the price difference make it a straight trade if thatll get it through- its still better than having a $600 phone in the box unusable...

just sent ecare an email saying that i have been thru 2 many touches and diamonds and i was contemplating switching to at&t for the iphone 3g if i couldnt UPGRADE my phone to its new current model the diamond..

lets see how it goes!
