There's nothing "broken" about that. That's been the behavior of the X-button since day one with WinMo. Anything that causes programs to close with the X-button is a third party add-on (e.g., HTC Task Manager).

It still has nothing to do with "newer builds of WM", like you said. The button behavior has been the same since day one.
