Since there is no case law on point, the end result is that it is illegal, but you will never be prosecuted for it.

Sorry, if this is more info than anyone wanted.
True...and everyone that has downloaded one of these cooked roms could TECHNICALLY be prosecuted....and everyone who has ever downloaded an MP3 without paying for it could Technically be prosecuted...and I could TECHNICALLY get fired from my job for typing right now lol. I agree with you though...I think people are clouding the real issue here with ID #'s and the like.

Corrected. Some poor explanation on my part.

Disagree. Predict: foretell on the basis of observation. Given that there have been no prosecutions for space-shifting (moving digital media from one device to another.) Then on the basis of that observation I can predict with a high degree of certainty that I will not be prosecuted.

Furthermore, most content providers are afraid of suing someone for personal fair use space-shifting in fear that a court decision will give personal fair use a broad interpretation and limit content owners' copyrights.
(see Newmark v.Turner Broad. Network, 226 F. Supp. 2d 1215 (2002) where the court dismissed a declaratory lawsuit after the studios settled a suit against Replay TV and promised not to sue individuals.)

Therefore I feel entirely comfortable with my prediction that I will not be sued for personal fair use space-shifting in moving my digital media from one device to another.

big difference between personal fair use and distribution, but a fair point.

Re: So the big deal with RAPH800

and according to the applications site , the app is designed to work with all of HTC phones including the Diamond ..but only for GSM devices...

So as one poster back said that the app doesnt care about the network but what camera it uses ..so im guessing that the app is using the device ID as a reffrence for what type of camera it is using...im guessing here !! being from a programers background this is NOT uncomon to do ..

But since the phoen is our property should i not be able to name it as i please? or is that illegal ? if so then how could it be ?

these are the answers we need ..hehehe...
the application is in trial version so it can be used freely.. besides i dont think that the cab file ( not the trial one ) is on this site, or is it?

lol - that's a self-defeating way of saying it; you may as well quit pretending you have a right if you're not going to sue because the courts might rule you don't. I agree with your prior statment more...check the terms of the license.

Ever hear the absence of data is not proof? A lot of people have ended up behind bars because of similar logic. I agree with you though, if the license doesn't preclude it, you're probably safe. If the license does preclude it though, you're unlikely to win a contest.
