Great, thanks for the all the help. I will be sure to look for a "clean ESN".

Do you know if it matters if she doesn't have a data plan. I'm going to go to a Sprint store and talk to someone is person, but I figured it's worth a shot on here. The reason I ask is because I'm not familiar with Sprint and their policies, and on one of the ebay auctions the seller stated that Sprint won't allow the phone to be activated unless you purchase a data plan.

Sprint will activate without a data plan. Not sure if it is a good choice of phone without data. Little things can use data at an alarming and expensive rate. If you go without, either be very careful or have Sprint block data.

Thanks for the info, thats a good tip, I can definitely see this thing using the data. I guess there is no way to disable it on the phone then?

You can disable data at the phone. I'm on my phone now, or I would look it up for you. Maybe later.

they (sprint) says they wont activate it w/o a data plan, so they dont sell it that way, but if you have it already like bought from ebay or a friend gave it to you (make sure esn is clean) and you wanna swap it out with your phone they have no choice... its your phone and your allowed to use any phone you want... regardles the plan... bu I will say, without a data plan you might as well keep they freebie phone she has.. I mean this phone is made to use data, what good is havin a smartphone and ppc if all your gonna do is talk on it... just my opinion... well i geuss you could always download games, music and movie and use apps like office w/o using data... but itll all have to be done through you home pc... for that just get an ipod and call it a day

oh and hibby's right, regarding the fact that she wont be able to use her sim cardd for this phone... it doesnt use sim card... it uses sd or sdhc memory cards... everyone else is right in the fact that, because she is a sprint customer she can use this phone on her plan, for her line... the only thing is she will have to put all her contact info and (whatever other info she wants) on the phone manually by hand at first and save it to her memorycard... then shell be good to go

If she is with sprint now, they don't use sim cards and if you buy a touch you would probably need a data plan if she doesn't already have one to get everything out of using the touch that it is made for.
