Ebay seller protection policy says:
Signature receipt for valuable items – For items with a value of US$250.00 or more, proof of signature from the recipient will be needed to show that the item was delivered to the buyer.

So it's the seller's fault not requiring a signature upon delivery. You will win the case as item not received if you file a claim with ebay/paypal.

But then they will probably tell you it was shipped to the address on the box. So if it was your address they will tell you it was shipped to your house. That's what happened to me when I lost my package. The sender had to resend the package.

I've filed the paypal claim a while back, and now I'm awaiting the results. Do you think I will win the case for sure since the seller did not insure the package with signature confirmation for the TP2 which costed me 430 dollars? Will I win for sure? Should I call my credit card company and get my money back then cancel the claim? What should I do? I'm not sure if getting my money back is guaranteed in this situation.

I escalated the dispute to paypal and the seller sent paypal the tracking number. The tracking number shows that it was delivered but no signature. Paypal is still reviewing the info and I guess they will get back to me on the 1st of November. Will I win the case?!

This hapenned to em once before to with FedEx though. They delivered 1200$ worth of PC parts to my front doorstep and did not get my signature, however when i got home from work, the items were missing. I tracked it on the website and it said i signed for it. I called FedEx and let them know my items show as delivered but they were not at the location indicated by the driver. They pretty much told me tough luck since i signed for it, i simply asked them to provide me the signature. They were unable to do so, so FedEx bit the bullet and paid me.
