Actually, it does entitle you to a new "equvilent value" new device, I heard that from an upper level manager at Verizon themselves. It's just you have to complain enough to get them to admit it. Why would they want to replace your phone if they can get you to keep taking refurbs. I did get mine replaced from the Storm to the Imagio after enough complaining.

I heard the same thing, but when I talked to two separate reps over the course of the last few weeks (post 2/1), specifically asking that question, they said that if my Imagio broke once more they would replace it with a TP2. In fact, I even went so far as to ask the rep about replacing w/nexus, and he said it may be possible if I have any more issues. I got my phone back in Nov, so I don't know what's up. That being said, I've found that if you simply hang up, and call again you'll get another rep and 9 times outta ten, they won't say the same thing as the first.

If all else fails, bi**h until your face turns blue

PS: AFAIK (and correct me if I am wrong), VZW offers a 90 new replacement warranty. After 90, you get a "like-new" for 1 or 2 years, depending on your contract. That being said, HTC will replace it with a new unit for up to a year. So, I would think that if you call HTC (assuming your outside of your 90 days) and whine about how VZW won't fix it, HTC just may. I would suspect though that going through them would require being phone-less for a period of time.

PPS: I FREAKING HATE THE LIKE NEW PHONES. I've had two thus far (one went back immediately) and all of em sounded like a blender in vibrate and light leak around the screen etc etc etc. It's complete BS.

They'll only replace it with a brand new one if it goes bad in the first 30 days, but you have to complian about that too, or they'll try to palm off the like new on you. I know because my Imagio has been replaced twice for bad buttons. Both times they went bad within the first 30 days and I got brand new replacements but only because it was within 30 days.

I'm on my third Imagio

1. 3.5 mm jack was stuck on headset mode even though the headset wasnt there ( common problem )

2. Multimedia button was stuck ( common problem )

3. My touch screen became unresponsive, I found later that all I had to do was removed the screen protector, it was suddenly registering as a touch, and since we dont have multi touch, the screen was unresponsive

So those are my 3 replacements, anybody have a higher number or better reasons

Actually they are making a pretty big deal about the multi fru exchange program being terminated. It's communicated every week on our weekly conference calls. If you happen to complain alot and someone caves in, they would have to "build" a fru kit for you. This means they would find a refurbished device, find a battery from a demo device that matches it and also find a back off a returned device and give to you. If I were you I wouldn't hold out thinking they'd replace your device with a nexus one. Most of the representatives you speak with over the phone will tell you just about anything to get you off the phone.

Here is my story... I got the Imagio in November, had it replaced three times I think.. On the third time I asked about the multi-fru.. It had just been terminated the week before.. I chose to do the survey where they call you back after the call.. They said no to the multi fru and sent me a refurbed imagio. I said on the survey I was very unhappy with the issues and that i was willing to "upgrade." I received a call the next day from someone at verizon out of Texas. They said they could upgrade me because i had a line available.. (we have four lines) and one was close to being up. I thought ok lets do it.. and he mentioned he could get me a droid for 79 bux.. I said "what. maybe you didnt understand sir.. I just paid 199 for this phone three months ago.. I am not going to drop another 80 to get a phone that works."

Anyways... I ended up getting a droid eris through him for free... as a multi fru.. I then dropped it a week later and ended up with a Moto Droid from asurion...

Yes I know I have now paid 199+89+monthly insurance costs for a droid that now sells for what 99 bux at wirefly.. BUT i am now happy and will never return to Win Mo..
