Thanks a lot, I have the number to the Sprint Fraud Department, but if you have another one please send it this way.

I have not been hit with a charge, I don't have insurance on my phone, but truthfully to me, the charge is of least concern. It wouldn't be so bad if I got hit with a charge, but if someone else is taking a hit for me getting a new phone, that's wrong and I would like to prevent that from happening.

Sprint and Asurion seem to be a little flip towards this whole situation, in fact someone told me that this type of insurance fraud is practically impossible, so for my own peace of mind, I would like to escalate this as far as possible and get some answers.

But, bottom line, there's a chance nothing will happen, then, theres also a chance something will. It boils down to if someone gets hit with the 50.00 charge for your phone, and how they pursue the matter.
Thanks for the quick response. Yea, it does looks like similar wording. Doesn't look like my sellers is listing any items now. If I were to try to get my money back what is the best course of action? Also, I'm pretty sure the seller will not respond to emails because if you look at the feedback every recent transaction said no communication.

Did you pay via PayPal? I'd open a claim with them immediately. State that you suspect that you recieved stolen property. Chances are, the seller already has other claims against him - what's odd, is that for some reason, I couldn't view a list of his 'completed sales' (which you can usually see an entire list of all the stuff they've sold in like, the last month or so).. so that in itself is a bit fishy too.

Anyhow, open the claim with PayPal. They may, or may not require you to retrurn the device to the seller in order to get the refund, but I imagine if the seller doesn't even respond to the claim, there's really nobody PayPal can *make* you ship it back to.

Alright, I'm doing the claim as I'm typing this. I will keep posting to see what happens. Also should I do anything with Ebay and my credit card company. (Thanks again for your help, I'm new to doing these types of disputes/claims)

I had a $50 charge against me and have filed with Sprint Fraud. It surprises me that some say sprint's fraud dept are not interested as they were very interested when I was explaining it to them. I did have to ask for the fraud department. They told me that I would be contacted within 7 days to inform me what is happening. I will post more as I find out more. If I don't here from them by Friday, I will be calling back. My account has been credited for the $50 already.

Well its official, if you bought from lkcarter his auction was officially cancelled and his account is gone from eBay.

I had the same thing happen - I bought from ariasss1 (Natalia Draghi) and my phone came in original packaging with no Asurion markings at all. She had lots of positive feedback, but suddenly she and all her listings disappeared. A tech at the local Sprint store said he thought it was an insurance phone, so I opened a Paypal case. She responded that all her phones had come from "a Sprint store that closed". I have called both Sprint and Asurion but neither can tell me whether the ESN is okay.

Why can't Sprint tell you if the ESN is ok? They have told me both over e-chat and the phone before.

Asurion says they have no way to look up ESNs. Sprint says the ESN does not belong to a phone that has been reported stolen, but they can't tell if it is from Asurion or not.

Yes, and to Sprint, that means the ESN is "fine", or so I've been told by numerous Sprint employees.
