Well. I dont have any kind of insurance on my account to begin with. I ordered from celldep0t and it was delivered yesterday. After activating it online, I sent an email to ecare and this is the reply I got:

I plan to refer this in the future in case Sprint wants to blacklist the ESN. Maybe they will say it was clean 'at that time' -- I dont know. Also, I am not sure if they can charge me $50 as I dont have any insurance at all. I think we have about 60 days to file a paypal dispute -- so I am going to be watching this thread and couple of similar ones (esp. 'ebay touch pro listing. lowest price, safe?') very closely.

This is snowballing into a one big headache.

Like I said at the start of this thread this is insurance FRAUD! Somehow this guy is getting sprint accounts and doing claims. I am going to forward this entire thread onto the FBI Cyber Crimes office in Omaha Nebraska. As well as the detective taking care of my craigs list purchase. Ive got the ebay names involved and this does need to be looked into.

I purchased a Samsung m800 Instinct on eBay (http://cgi.ebay.com/ws/eBayISAPI.dll...m=280281153597) several months ago 10/30/08. It came in the mail ship from the seller (celldep0t) through FedEx and I got it the next day. I activated it no problem and am tired of the phone. I just purchased a Sprint diamond on Friday and got it Monday 12/1/08. I activated it no problems. All in all I am happy with my low price and the seller seems legit and did not do me dirty.

The only thing I can see happening to me is my phone becoming blacklisted. I don't know how long that will take. It could be a month from now or never.

I don't see how it would be even remotely possible for me to get a valid charge on my bill for a ~$57 insurance deductible and a $200+ charge for not returning a phone to Asurion though since I don't have insurance on my line. Never have, never will. My family has been a sprint customer for 7 years now and although we've had insurance on other lines, it has never been on my own. We share a family plan with 3 lines.

I'm still on the fence as to what I should do.

I tried to buy a Diamond from infitelusa over the thanksgiving weekend, but my order was cancelled and refunded yesterday. Their excuse was supplier problems not updating their available quantities, or something along those lines. After reading this thread I wonder if they checked and saw I didn't have phone insurance with sprint and thus wouldn't be able to pull the little trick. It seems kind of risky for someone to do that when they are a power seller though and risk their rep. Maybe they figure by the time people get billed they'll already have left positive feedback.

I have to wait for the refund to clear before I get it back in Paypal (and I assume they'll take their live.com cashback back), and then I might look for another one, though I'm not sure what to look for now to know a seller is legit. I'm pretty annoyed that my order got cancelled though since I got it with 30% cashback, and now cb is down to 20-25% is all.

Well, I brought from celldep0t awhile ago and it was shipped fast to me next day by Fedex also, The box didn't have any other items in there except the phone, So I'm not too sure what is going on with all these $500.+ phones at half price or so on ebay. I just don't want to get slammed hard by Sprint or anyother company for a bill for whatever. I did also buy from infitelusa and they refunded my money back 1 week later telling me they don't have the phones in stock anylonger, So I gave him a negative FB for wasting my time since they had no phones from to start to sell, or maybe the insurance company found out what they were doing.

Just throwing 2 cents around but if the phones are coming from the insurance company they are keeping track of the IMEI and Serial number in their computer data bases when they ship the items out. Once you activate on your account it probably sends a trigger to Asurion that the phone has been activated.

I have purchased the same phone and I am in the same boat, personally I think that Asurion should allow us to keep the phones and go after those who commited the fraud/scam themselves.

User on ebay whom I purchased through was johnjohn0317 , and he had a very good rep himself with 100%. He has since been removed from ebay and I received an alert from ebay about the purchase made " DO NOT COMPLETE TRANSACTION" (about 2 weeks too late for that since I have the phone active on my account now)

I am going to wait it out to see what happens and if I get the charge I have all my records in place showing the phone sale from Ebay and the cash transaction from paypal through hard copy and soft copy. If Asurion wants to charge me for the phone then I think this may be a means to contact my local attorney general to see what legal actions I can take.

I did speak with Paypal Security , they are stating to do a dispute because the item received was not as described meaning they did not include this was an insurance transaction. So I may go ahead and do that just to be on the safe side.

Hopefully this will just pass and I have to do nothing but the more I read and see about this scam the more I am thinking this is heading the wrong direction.
