I think the Key words is "$75 upgrade" which you get after a yr unless you are premier then you get $150 which like Mordy state is an auto renewal of the contract when used. You are talking almost a yr ago, that is going to be hard to get out of without paying a ETF...now if you would of caught it right away maybe sprint would of done something about it.

Yeah, unfortunately, I kind of realize that now. I don't see why you can't use your upgrade credits without renewing your contract. I think the biggest thing that gets me is I specifically asked the corporate store rep that was helping to handle my situation if this would renew my contract because I didn't want it to and he confirmed that it didn't. I think I'll still call and see what my options are.

ahh one of the joys of buying at a Sprint store. They tell you just to sign here and there and don't tell you about the contract.

Well, it all started with eCare. I emailed back and forth with them for a while before they called and offered the replacement. At the time Telesales was out of stock of Touch Pros. So I asked if I was able to go into a corporate store to which the rep said I could. She emailed me back all the information which I printed and took with me. That was a mess as I spent the next 4 hours there with a corp. store clerk on hold waiting to confirm everything with whoever their superior helpdesk is. The only thing I ever signed was receipt for the phone... I'll have to dig out the receipt and see what it says.

Yea they got you on that. By now its too late to do anything about it. If you caught within the 30 days you would have been able to do something about it. Its happened to my wife in a similar way. She ordered the instinct over the phone. using the 150 upgrade credit. She didnt like it and returned it. By the time that they got the phone and the credit took forever. they then did not credit the 150 upgrade maybe untill like 6 months later. So it was a big mess. dealing with anyone on the phone with sprint is terrible they will transfer you to different departments and you need to explain to each on the problem again and again. i either talk to retentions or get the phone in store. retentions is pretty good ive had sprint for almost 12 years now and they will do anyhting to take care of me. but good luck with the contract. they now will prorate the early termination fee. once its past 5 months it will take 10 dollars off each month from the 200. the lowest it will go is 50. so really after 10 months it will get down to 150.

Well, it may all work out after all. I took my TP into a repair center as the GPS was wonky and texts were coming in late/out of order/and all at once... Anyways, offered to replace my TP with a small list of phones (See the thread in the TP forums) and chose a Pre. So I'll check the Pre out for a bit, but still might TOL my account and sell the Pre later on...
