I may be a lurker here but I have multiple accounts all over on internet forums under multiple ailiases. The major issue is it does occur and it does to a serious extent. For instance it's clear Sprint through the EPST or the actual phone, can send instruction that takes over Oncrpc.dll and smd.dll and then can screw with the application layer instruction to prematurely shut downloads, and also to nullify legitimate activity EVEN WHEN OFF THE SPRINT NETWORK! These are the grounds for the anger. What I do on the Sprint Network is one thing what I do off the Network is none of Sprint PCS's business.
I was able to get a "home made" program from a friend in the Yonkers that monitors all the instruction executed on the device. I'll be in the process of using the phone and a lot of instruction gets executed in the rom directory at boot up or in the event I wan't to acces data services or some specific program that would lend too much leway in curbing data acces or getting acces to info giving me a leg in the fight.
It' actually got worse at this point because extra instruction from Sprint, when my phone, not EVDO services are on, the instruction and additions runs up my KB count more than my using it (because drastic increases are made on my KB count even though I knock out data and stop all EVDO use for a few days). I'm not even mentioning TF3D and other processes on the device that run slow as hell or sometimes don't run when I access them because of all these additions that are made that don't harmonize with the Touch Pro. They just clogg up the fluid movement of well made, well tested ROMs, that have before this craziness worked beautifully. Lastly lets say you could not monitor the instruction execution on your device, when processes you have running on your Touch Pro mysteriously close after you have run up over 5GB on your Sprint services for one month only, and then you use the wifi and processes on your wifi connection close out when you do searches on how to bypass the blocks Sprint places, you know two things. If you are doing regular browsing and this does not happen, then you know sprint can monitor off network activity on your device. The second thing you watch is how your processes close. If applications close in the same way they did while on the Sprint Network, or you are no longer able to do things that once before you were, you've zeroed in on the Culprit.
There is a light at the end of this horrific breach of privacy. I was told by legal counsel to think about what I am about to do before I were to persue the lawsuit. I was told to give it about two months and still compile the network activity and not to go over the 5GBs. If the activity escalates then I should re-evaluate my decisions at that time.
So anyone on the SPCS network beware, but at the same time know someone is going to fight this with awsome legal help that played the devil's advocate as well to see how my case stood up. I still would like any help or input on experiences. I may open up a thread that no doubt will turn heads. I wan't to see the full extent of where Sprint goes next, first.
