It is going to make any difference if I flash with the hard spl 0.37.cmonex on the replacement and back to 0.37.0000 with the relocker if need be, or will the relocker put it back to 0.40.000? Is it gonna make a difference if I relock the new phone to 0.37.000 since its not the stock locked spl of 0.40.000?

It will work. I have returned 3 tps that i relocked. My first replacement had the same 0.37.xxx so I had no worries. Second unit I got as replacement was the 0.40.xxx. With no update to the unlocker/relocker I figured WTF and went for it. It all worked fine for me. I am sure if it were an issue we would hear about it, and a new hard spl would be put out.
A month later my TP hard keyboard died without fix so they sent me another, time to send back the first 0.40xxx. I relocked it, it said 0.40.xx again, and I sent it back.... never heard a thing. Then a couple weeks ago, I had a prizm under the screen show up and again they sent me a refurb(
) and again. 0.40.xxx. I unlocked it, relocked the bad unit and sent it back. Still no word from Alltel/Verizon busting me out. I believe the change in numbers is due to the official HTC upgraded ROM that was released this summer for the Alltel TPs and since anyone can flash the official HTC release without unlocking, the change in hard spl is no sign to them. Worked for me.
