The president and a few other bodies in the government have the power to overturn the ban. All it will take is for Verizon and Sprint to grease a few palms and it will be business as usual

Plus, if Sprint truly was launching on 18 June, a mere ten days away, they have a stockpile of Moguls in the US already and are not affected unless Qualacomm loses on appeal.

Remember, Vonage was blocked from signing on new customers, but that only lasted what ... 3 days? I'm not panicing.

Unless someone knows the exact dates that Sprint "imported" the Mogul and is an attorney specializing in this specific field along with an inside to this specific case, the politics of each side with the judge and his/her history, etc..... Everything is speculation, and nothing more. The 6800 maybe totally exempt, it may just inside the ban, it may end up being a bargaining tool or threat in court by either side in the hopes of getting something else in the case.

Even if Sprint made an announcement tomorrow morning that the official release date is June 18th, does that mean the court cannot stop it? Even if Sprint announced it cannot launch any new phones until this is settled, does that mean it cannot be resolved to a point that Sprint can launch the 6800 by June 18th?

Just like anything else, this is very simple and clear......we are left with only sitting and waiting and watching.

When it hits the shelves, that will be the day it is released.

There is a cease and desist order, the phones will not be released until that is lifted, and thats a guarantee.

As with anything in the legal world there is no such thing as a guarantee. there will be a stay of this decision for appeals by qualcomm and most likely the 3g networks that are effected. I would expect both Sprint and Verizon having paperwork filed open of business on Monday...

Verizon's Stark said her company is also planning to file for an immediate stay of the ITC's decision with a federal appeals court and to lobby for a presidential veto of the order. She said she wasn't sure whether Verizon would be filing the documents solo or with other wireless carriers.

She added that the order is unfair because wireless companies and manufacturers weren't able to be a party to the liability portion of the proceedings, and they were never accused of patent infringement themselves or found to have infringed.

"It violates our principles of due process and fairness by punishing us when we haven't been accused of anything or found to infringe," she said.

Exempt?

Saw this on PPCThoughts:

"Exempted from the ban are chips installed in PC Cards, PDAs and "smartphones" (lower case "s") defined as phones with full QWERTY keyboards."

If true, this would mean the Mogul wouldn't be affected by the ban at all, regardless of when it was technically imported. Still trying to run down a source on this, though.

I don't know if you guys saw or not but the PPC-6700 is back up on Sprint's website on both Personal and Business lines. That doesn't sound too promising considering the fact that the 6700s were suppose to be out of stock or not carried anymore.

That's what I did! As long as you live in a 3G area, you'll never know the difference. Also, the vast number of GSM Pocket PCs are far superior to even the 6800. Go checkout www.pdadb.net and you'll see what I mean.

Yeah, but GSM is an open system. Any unlocked multi-band GSM phone will work with any GSM network. You can buy any number of phones from several overseas internet stores, and of course, there's always eBay.

Anyway, the 8525 is toy compared to what's available. Go Google the Imate Ultimate 7150, O2 XDA Flame, or HTC Advantage or Athena. Then tell me how good the 8525 is by comparison.
