Laws are laws, while some are lenient..in this case this law is prosecuted even if you own both phones. In the past people abused ESN cloning as you mentioned and now everyone is punished by it...

While we all wish for all phones to be open on all networks, carriers do not..and they make sure these laws are fully prosecuted as it benefits them...

That said talking about ESN cloning is also against the rules of this forum..so regardless the topic is not to be discussed.
