So........ If I clone a smart phone to a smart phone. A smart phone is Authorized on that account. And I have paid for said smart phone. I have paid for the service during this time.
And I dont use Voicemail on the device. And I told the carrier what I was going to do. I am now facing 15yrs in the pen. With the overcrowded prisons though. I really dont see someone getting put away for this. Maybe a fine if they are spying on there wife, as she is out getting railed in the shed out back by pool boy. Leading you to go kill your wife and the pool boy. But at that point I dont think that ESN cloning is your issue. All carriers also have very strong networks to detect this. If I have multiple phone powered on. One active, and one not active, but powered on. I will will have data cut in and out the entire time. This is due to Verizons system of detection. It detects multiple phones with the same MDN number. It then cuts service to both of them for a given amount of time. So If I had to say, I would say hack away. Is this legal in Canada by chance? I'd like to get a newer CDMA device from the US and use it on Telus' old CDMA network (grandfathered plan they won't let me keep on new GSM network).

It's a grey area in Canada, Its a breach of contract with the service providers. Discussion here about it will not be permitted even if you're Canadian.

This is just me... but i feel ESN cloning is no different then unlocking a sim to put say a iphone on t-mobile....

True what conflipper said don't think anyone is going to dedicate themselves to finding cloned esn phones . The carriers have systems set up for this but you have to have both phones on at the same time to get caught but if you do get caught because you had both phones on at the same time then you should get caught for being dumb.
I think and its probably been stated on here already. That the whole law about esn cloning was because of the reason it was done for but now in days that's not the reason and were still paying the carrier for the service were not stealing service were paying for it. Everyone that wants to do this is going to and is doing this no matter what the law says.

If I understand correct, the law was put in place when cellular networks were still using Analog signals. This wasnt very secure and so forth. Could skin SIM card, and use other people plans.
Then the digital networks come along, and make everything a lot different story. I predict in 50 years, the law will still be in place, but we will be running out of pESN #s, and start to use ones from today. Or something along those lines, but with the same law in place. I do agree that one should be able to do as they choose with their own phone, including an ESN change to their own phone with their own device. I also like that there is some protection in place, unlike a sim card, where it can just be easily swapped by switching sim cards.
