it is not illegal if both phones are his and he will be keeping them both (NOT selling OR giving to anyone).
the only thing illegal is having two phones operating under one esn (cloned from a paying customer and share their line)

you can easily change the ESN of your touch pro as your old phones ESN, i would recommend to talk in this mindset on this site and it will get you further. be sure to destroy the old phone if its a crappy one, like that there is no problem with a dual ESN and thus clearing the legality of this thread...

now can someone please give quantum some assistance? im tied up at the moment...
