A bad ESN doesn't necessarily mean the phone is stolen. Sprint will also blacklist a phone if the account has an outstanding balance that the user won't pay IIRC.

return to buyer on ebay? dude you got scammed. Contact him, tell him he's got 24 hours to respond or you'll go to the authorities. You can, ebay has protection.

How did you pay? Paypal? You'll be able to contact paypal as well and file a claim.

Sounds like a scam. If he didn't mention the phone did this in the auction, he scammed you.
