Weren't you ever taught that "two wrongs don't make a right"? I don't care what Sprint does or how they behave. I'm responsible for me, and I'd do the honest thing and either contact them or send the phone back. There are moral absolutes, in spite of what some would say.

I know in New York it wouldn't be stealing, but it would actually be catagorized as a gift, since he did nothing illegal to be sent it, but tell him to go with his conscious...and keep it. lol.

That is typically the case when a company purposely sends unsolicited merchandise and expects payment in return. The phone in question appears to have been sent by accident. And accordingly, it should be sent back.
