yes its a soft cap.. the soft cap has been around for a while now, close to 2 years i believe(maybe 1 1/2)... its meaningless, but Sprint does try to claim that the benefit over 4g vs 3g is unlimited data vs 5gb of data... though they do nothing to anyone who goes over 5gb..
