OK, I called Sprint. The guy said that someone most likely returned this phone within the 30 day period and they resold it as new. He said they are supposed to clear everything off the memory first, but someone must have dropped the ball on this phone and forgot to do that. But he said they will clean it out, re-wrap it in plastic, and re-sell it as new.
Does that sound right? Legal? Could I find out why it was returned? Is something else wrong with it? |

question... I too have a new diamond that was sent to me as a "replacement" and they want me to send back the old one?
Must I send back everything? Or can I just get away with the phone? Keep extra charger or stylus? Battery? |

Keep everything else, they just want the phone back. They should send a 'return kit' that you throw the phone in and drop it in the mail.

So, do you think I can return this one because it isn't really new? I just don't believe they can legally sell this as 'new' if it's not new.

I would be pissed. Though I do believe that it is in their discretion on what they send you. And it wouldn't make good business sense to send everyone a brand new one...
