I dont think this is true. You can do it through Asurion and also get upgraded to the TP if they don't have any moguls left. They are out of moguls at the same time the sprint page shows it can be replaced with the TP. My friend did it last week and he got a brand new TP from Asurion. The only thing is that you still have to pay the $50 even if you have TEP. I did it yesterday with them 'cause I did lose my mogul so couldn't do it through Sprint but it was at that time that it was available to upgrade to the TP on the sprint page. I am still waiting for the tracking info from them, I called today and they said that I should get it today or Monday at the latest, but they confirmed that I was approved yesterday and that I'm getting a new TP. They charged the $50 but it is definitely worthy. You can also file a claim online at phoneclaim.com, the TP will appear there if they have no moguls in stock, you just got to make sure the sprint page it's showing that they are replacing moguls for TP because with Asurion you can't cancel the claim, they know when you started the claim so if you exit and then try again, they will tell you that you already started another claim, to continue that one, or call. I just hope I get my TP soon. Good luck to others.

I called Sprint last week on Wednesday night becuz my mogul stopped ringing. They placed me on the phone with Asurion and the next day I received my brand new Touch Pro in the box! I was expecting it on Friday or maybe even Monday. It was shipped overnight!

I don't get how some people are being sent a TP and when some people like myself call in they send the Mogul. This is my 4th phone, 1st through Asurion but regardless I'm tired of this phone. It's so slow, i even asked if I could have a standard phone and it was a no-go.
