i jus got lucky and got a brand new one in box like 2 weeks ago. the function (blue dot) key was on life support. i had to grind down on it super extra hard with the flip side of my stylus to get it to register. but pretty much if they got a refurb in the back...no matter how u approach it, that's the one u're gonna get.

If you want them to replace it with a brand new one, then you have to unexpectedly bring it in rendered completely inoperable. I would wait and just let it die by the time the touch pro is out. They will only make you wait 3 days for a refurbished one to be shipped if you can still make and receive calls. If it's dead, they'll give you something comperable immediately (the touch pro would be that immediatley available proper replacement). This is how I freely went from 6600 to 6700, and then 6700 to 6800. 6600 gave me dark screen of death, 6700 got knocked out of my hand just as I was about to bring it in to get repared/replaced for crashing, but the screen got smashed anyway.

i also got mine replaced about a month ago with one brand new in box. If you call CS and they send you one, its usually a refurb. I've noticed every time i've had mine replaced in store, it was always new in box. I know this because they then always asked if i wanted all the extras that came with.
