so i sent a message to sprint and this was their reply
Thank you for contacting Sprint. We apologize for the inconvenience with the handset. Sprint offers one year Manufacturer Warranty against any manufacturing defect through which faulty phones can be replaced with the same model. Your current Samsung Epic was activated on October 12, 2010 & is still under one-year manufacturer’s warranty. An onsite technician needs to check your phone and determine if this particular defect is covered under manufacturer’s warranty. Once the defect is determined and if it comes under warranty, you can replace your faulty phone with the same model. To ensure that, you can visit a nearby Sprint Service and Repair center. Please ensure a prior appointment for immediate assistance at the Sprint store. because i tried going into the store to get it repaired, im just not someone who can make a fuss or get angry in a store this was just as easy, i filed it and they said they would pay for it so its free to me.

PACMAN, you f'd up.... there is something with the phone and the manufactures warranty being removed once you get a refurbished phone from the insurance. You basically swapped a new phone for a used one with out a warranty.

I took mine in to Sprint for a manufacturer's warranty issue and they ordered me a new phone. I had to pay the $35.00, but the lady at the store made a point to order a new phone and made sure I didn't get a refurb. I was also told that if I put insurance on the new phone that if I ever have to replace it again for a similar manufacturer defect that they would not charge me the $35.00. The only time you should EVER use Asurion to get a new phone is if you lose it, it gets stolen, or it suffers water damage. Anything else will be covered by Sprint's repair / replace service and if you have insurance they waive the $35.00. You just have to make sure that they order a NEW phone not a refurb. Oh, one other benny I got from all this was that they took my old phone and gave me a new one in the box. They even let me keep my battery from my old phone. So now I have an extra charger, USB cable, battery and headphones. That alone was worth the $35.00, and I added insurance to this one so if I ever have to replace this one it will be free.
